This decision will impact users who will no longer be able to engage in listing, bidding, or selling items on the platform from November 27, 2024. The complete shutdown of the marketplace is set for February 27, 2025, allowing users a window to withdraw their assets.

Kraken’s NFT marketplace, launched in beta in November 2022, faced challenges in maintaining momentum amidst a general decline in NFT sales. Weekly NFT trading volumes have consistently remained below $200 million since April 2024, indicating a stagnant market with sporadic spikes for certain projects like CryptoPunks.
Regulatory Concerns in the NFT Industry
Enforcement Actions and Legal Uncertainty
Recent regulatory actions, such as OpenSea receiving a Wells notice from the SEC, have added uncertainty to the NFT industry. The SEC’s scrutiny could potentially categorize NFTs as securities, following past actions against projects like Impact Theory and Stoner Cats. This legal ambiguity has prompted some companies, like DraftKings, to exit the NFT space due to “recent legal developments.”
